Personal Liability

When you accidentally damage or injure

The Company will indemnify up to the Sum Assured (less the deductible) specified against any legal liability incurred by the Insured in his private capacity to pay Damages for third party civil Claims arising out of Accidental Bodily Injury or Accidental Property Damage occurring during an Insured Journey. Actual legal liability including the defence costs incurred or which You are liable to pay to a third party, while you are on Insured Journey.

What is Personal Liability Coverage?

Personal Liability coverage (also called Third-Party Liability) in simple terms.

This is one of the most underrated yet crucial benefits in travel insurance, especially for international trips.

Personal Liability cover protects you financially if you accidentally cause bodily injury to a third party (another person) or damage to their property during your trip.

It covers:

Compensation you may have to pay to the third party (as per court or settlement).

Legal defence costs, court fees, and related expenses if you're sued.

Examples:

You accidentally knock over someone in a crowded market, causing injury → the policy covers their medical bills or compensation.

Your child breaks a hotel's expensive vase or TV → it covers repair/replacement costs.

You scrape a parked car while renting a bicycle → it covers the damage to the vehicle.

This cover applies only to accidental and unintentional incidents. It's particularly useful abroad, where legal systems differ from India, and claims can be expensive (e.g., in the USA or Europe, even minor accidents can lead to high lawsuits).

Typical Coverage Limits in Indian Insurers' Plans

Limits vary by plan (basic, silver, gold, platinum/premium) and insurer. Most overseas travel policies include this as standard (sometimes as an add-on in basic plans):

Entry-level plans — USD 50,000 to USD 1,00,000.

Mid-range plans — USD 1,00,000 to USD 2,00,000.

Premium/high-sum-insured plans — USD 2,50,000 to USD 5,00,000 or more.

For Schengen/Europe visas, while medical coverage needs minimum €30,000, personal liability is often higher in good plans. I always recommend at least USD 1,00,000–2,00,000 for trips to developed countries (USA, Europe, Australia) due to higher litigation costs. For Asia or Middle East, USD 1,00,000 is usually sufficient.

Domestic plans also include it but with lower limits (often ₹1–2 lakhs).

Conditions and Exclusions for Claims

Claims are approved only if the incident meets policy conditions. Key points from most Indian insurers' wordings:

1. Must be accidental and unintentional — No cover for deliberate acts, negligence, or if you're under influence of alcohol/drugs.

2. Third-party only — Doesn't cover injury/damage to yourself, your family, or your own property.

3. During the trip period — Incident must happen while the policy is active (from departure to return to India).

4. Legal liability established — The insurer pays only if you're legally held responsible (via court judgment or settlement). They may defend you in court.

Common exclusions (these void the claim):

Intentional/criminal acts, illegal activities, or violation of law.

Professional/business liability (e.g., if damage occurs during work).

Ownership/use of vehicles, aircraft, or watercraft (e.g., no cover if you drive a rented car and cause accident — separate rental car insurance needed).

Contractual liability (e.g., signed agreements making you responsible).

Damage caused by pets/animals you're travelling with.

Transmission of disease/illness.

Participation in high-risk/adventure sports (unless add-on purchased).

War, terrorism, nuclear risks, etc. (general exclusions).

There may be a deductible (e.g., USD 100–200) that you pay first.

How to Claim Personal Liability

1. Immediately inform your insurer's 24/7 assistance helpline (don't admit liability or pay anything yourself).

2. Report to local police and get a report.

3. Gather evidence: photos, witness statements, third-party details.

4. The insurer's assistance team handles legal aspects, negotiations, or defence.

5. Submit documents: police FIR, court papers, bills, etc.

Claims are usually settled directly with the third party.

This cover can save clients from huge out-of-pocket expenses abroad. Always read the policy wording carefully (available on insurer websites) and choose a plan with higher limits if travelling to litigious countries. If you share your trip details (destination, duration, family/solo), I can suggest specific plans! Safe travels!
